Two easy questions

Hello all, I have 2 questions in Fog 2.0.
1.In page 124, we read that BGs that are at or below 50% of their original number of bases, cannot be rallied and are destroyed and removed from the table at the end of any JAP. This also happens even if the broken Bg is still in contact with pursuers, or has to be free of contact to be removed from the table?
2.When a commander is in position to influence a CMT of a BG he can command, can tha player decide not to do so? Or is it compulsory, since the Com. is there?

1) The broken BG is removed immediately the same as an autobroken BG is at the end of the JAP.
2) If the commander is within command range then then the use of his modifier is mandatory, not optional. This has been discussed before in situations where the owning player wanted a BG to charge without orders.
