thanks for the prompt replies. The way you have decided on ownership of districts makes sense and is reasonable. I can see both sides owning 3 full districts after the first move, depending on how people move.
some more questions.....
1/ If a player no longer owns any county at all is he eliminated from the game, or does he become a landless army of 1,000 points?
2/ When a player loses a battle presumably he has to retreat can he retreat into an enemy owned territory? If he does so and there is no enemy army to contest it does he own that county?
3/ if he is not allowed to retreat into enemy territory and there is no friendly county to retreat into is his army destroyed?
4/ If his army is destroyed but he still owns counties does he raise a new army in one of his counties? Who decides which county any such army is raised in?

I've just tried to set up a couple of battles.
In open battle both forces come in multiples of 100 points. You cannot set up 1050 against 1000. I suggest the easiest solution is to decide that armies that are only 50 apart in strength are actually equal and fight at the size of the smaller army. Civil war armies fluctuated in size from week to week, no General ever knew exactly how many men he had at the beginning of a battle.
Reinforced armies come in multiples of 100, opposing armies come in multiples of 100 + 80. the default starting point is 1200 to 980. So you will need to set rules for deciding what size that reinforcement is.
I set up our return engagement for the Roi Soliel tournament several days ago......am waiting to withstand the Russian hordes

We'll see Warlord Scotland will definitely be in play now,... although clearly Kerry D will have Irish Royalist in leaning I'm afraid Kerry D is going to have to join the Parliamentarian cause I'm afraid (starting in youngr's old county of Hampshire) as I've promised youngr he had the 1st option to switch to frilly ruffs and good catholic hessian underpants . One day we may redraw the map with shipping lanes to Ireland when I get time (that would complicate moves even more!) If more than one force is fighting for a province the lowest casualities wins the county.
A force other than a flying column moves one county at a time
A force designated as a flying column (more cavalry, dragoons, detached musketeers, and light guns than infantry) can move two counties in one move.
You may only have one force in play unless points exceed 2000 points
You may play as an independent (by declaring yourself king or protector) or form alliances but only with your own side.
Players can join at any time when their are unclaimed counties
