Error strength point or Upgrading

Question why can an entity after moving with 5 skill points to upgrade, although in fact are intended only 2 strength points?

From the icon below the unit (a full roundel) it doesn't look like this unit has moved? Is this your unit or the AI?

It is the enemy unit that is retired after an attack

Do you mean to say that you attacked (in your turn), the unit retreated from this attack (also in your turn), and the enemy unit repaired in the enemy turn (without moving again)?

If so, I think this is correct? The rule is that units that have moved this turn or are adjacent to the enemy can't do a full repair.
