Drop for Flank Charge and evading

A unit in skirmish formation is charged in the flank do they drop a CL for flank charge if not contacted?

The rules on page 33 say the drop happens before/after defensive fire (depending on stuff) it doesnt mention that it does not happen if the unit evades and no contact happens. I say it doesnt but the rules do not explicitly say this.

No. You only drop a level if you are actually contacted on a flank or rear. See the 3rd bullet point on page 33.

As an aside, it may be worth noting that in practice you can't get a flank attack with cavalry against infantry in fogn, the infantry just need to form a square as a charge response and they then have no flank at the point of contact.

Check again, its infantry Skirmishers he is referring to. They can not form square while in skirmish formation, and have no choice but to evade.

As stated above you only drop if contacted in the flank or rear, not for being charged in flank or rear. they better hope they roll long on the evade roll.
