define with unit

In need of some clarification on a commander being 'with a unit' to help influence a cmt.

In our game a unit of conscript Frogs was defending a building, they had made their cmt by having their divisional commander with them. Next turn this same divisional commander wanted to stay with the conscripts in the building, but had to move outside the building, still touching the terrain piece to rally another unit. If he stayed inside the building he was more than 4 mu away.

So is the definition of being with a unit that is defending actually occupying the terrain piece with the unit or is just touching the terrain piece good enough?

I think it is clear a unit is either with or not with. And you can make these changes in movement or Recovery phase.

Touching is nearly irrelevant. If a player told me they had a general with a unit but left too much space, I would say they are with the unit.

If the commander had to move to somewhere else to achieve a different purpose, that is a pretty good indication of not with.

It came down to base size in this case. He was in the building with the infantry having been used to get them the modified roll to CMT into the building. However from the building edge he was out of range of rallying the unit, so out he pops and now his 60mmX60mm base (28mm figs) is in range of the unit he wants to rally. He is no longer in the building, but was needed next turn to be with the conscripts in the building to help them get out.
So when he popped out was he with or not? I thought not as the unit he is supposed to be with is inside and he is outside.

Unit in building is in entire building out to its edges. Commander was touching building edge = touching unit edge.

A unit 'defending' the building is considered to be occupying all edges. Therefore a commander touching the building is also touching the unit - and therefore still leading it.
If the unit in the building is only 'occupying', then it is not considered to be touching the edges, and the commander would need to be at least partially in the building to be leading them.
