overlaps not that apparent

In our game today we had a situation where a unit of horse and a unit of swordsmen were contacted by a P&S unit. From previous maneuvering the horse and the swords were not in a straight line but were slightly tilted away from each other. the P&S unit contacted one base of the cav and one base of swords. due to the odd alignment they could not conform. If they could have conformed the outer sword unit would have been in an overlap position, but was not actually physically in corner contact with the P&S unit (trying to avoid ++ in impact there). During my turn I was able to conform both units to the P&S and the swords were in overlap. during the first turn we did not count the outer sword as being an overlap. should they have counted as an overlap from the beginning?

p102 gives examples of overlap...

-full or partial side edge contact w enemy fighting to front (nope)
-beside friendly who is in full frontal contact (nope)

From memory : if they cannot conform, should it not be resolved AS IF they had conformed as in FOGAM .

Even if there was no room for the overlap base because of angles? With that, if I only have a basewidth plus one of those nat's todger thingies, I get an extra base into overlap because it sticks out behind a BG beside me?

You need to have the necessary space for the overlap

When I conformed I managed to squeeze in beside the Tercio that was beside me so just enough space, it was hard to tell pre-conform though. guess if they could not fit as an overlap they would have dropped behind as a rear base. Started out as 4 superior swords, 2 got shot to death so only 2 left in the end.

Nope, they wouldn't have conformed if they couldn't fit.

You should also check the 4th bp on page 102:
In cases where it was not possible to conform ... Front corner to front corner and side edge to side edge contact with a friendly base counting as fighting as if in front edge contact with enemy.
In the melee a base contacted only partially* counts as fighting as if it were in front edge contact so the next base along would get to fight as an overlap.

*perhaps even on a flank edge!
