If the Germans reject the armistice and there is no Vichy France, at what point do the Free French activate (assuming they do)?

November 1942 if I recall correctly.

Does it matter if the Axis take Agadir first? (The North African gambit seems to be popular lately)

No. De Gaulle will invade anyway and the units in the invading hexes will go to the force pool. These forces actually came off-map and can't be prevented.
