Drawn Melee - who tests?

Our first game this afternoon without an experienced overseer, this caused a bit of discussion - Situation is as set out below -

:shock: = Horse with pistol facing down
:? = Horse with Light Lance/sword facing down
:twisted: = Determined Horse with pistol facing up

:shock: :shock: :? :?
:shock: :shock: :? :?
:twisted: :twisted: :twisted: :twisted:

:shock: do 1 casualty
:? do 3 casualties
:twisted: do 4 casualties, 2 against each of the Horse BGs

:shock: tests because it has lost 2:1, no issues with that.

The question - does :twisted: test as it loses part of the melee 3:2 or does it not test because it is 4:4 overall.

The latter; it does not test as it has not suffered more hits from all its opponents than it inflicted on same.

They took 4 total and gave 4 total so no test for the determined horse.

Thanks for the replies, "no test" was my position so that is a relief 8)

Don't forget it will take a death test and lose a base on a 1 or a 2 though.
