Was playing a scenario and both sides had reached the break point, my AI opponent far further over than I. The game ended and it said "Congratulations on the Victory" which I thought odd, but then it treated it in the stats as a draw ? (which was correct) Maybe something to look at in the programming.

Thats how its been working since this issue was addressed in a patch - which involved the draw being applied on the victory screen (in the form of no reference to a victor).
It would avoid confusion if the congratulations referred to the draw and a draw announcement was actually made on the victory screen like it does for a time ended draw.

Just had this problem on a MP game.
The fact is that when both sides go over their break points on the last turn BOTH players get the "You are victorious" message, as my rival has confirmed me with screen-shots and all.
I guess this is definitely a bug.
The game should give a Draw message to both and not a Victory message to both... if at all, it could be a "you lose" message to both players as both reached their break point on the same turn. But a Draw looks fairer to me.
This problem can be specially troublesome if playing some kind of tournament...

True, I just had exactly the same in a game vs Teppsta.
We both went over our break points in the same turn, and we both got a message we were victorious.
Or maybe that's the propaganda our respective generals will tell at home
...
