Do Swiss keils have "deep pike" bonus even in "not open" terrain?

Two situations where Swiss keils have "deep pike" bonuses despite being in "not open" terrain (streams in this case):
1. My German Imperial Landsknecht keil (right center of screenshot, with the general) is on a 25-meter open ground slope, in melee against a Swiss keil in a stream square at ground level. The Swiss keil initiated melee - how does it still have the deep pike +100 POA bonus despite being in non-open terrain?

2. A second German imperial Landsknecht keil (fragmented) is in melee against a different Swiss keil. Both units are in stream squares. As my unit is fragmented, it has lost both the pike (+100) and deep pike (+100) bonuses. However, how does the Swiss unit still have a deep pike bonus despite being in non-open terrain?

Either I'm missing some aspect of the rules, or there's a bug in the way the game engine is determining deep pike status.
