Superior BGs in ancient spanish list

Hi folks,
a player contected me with an interesting question about the ancient spanish list concerning the FoG 2.0 revision.

Since FoG 2.0 he is allowed to field up to 1/3 of the BGs of scutarii and heavy caetrati as superior.

Now the question arises what happens if he takes an spanish allied contingent. Clearly, the allied contigent can't have any superior troops of the kind because the FoG 2.0 rule explicitly exclude allied contingents.

But, for the number of the superior BGs in the main army, do the BGs in the allied contigent count? (It might be, since it comes from the same list and troops in the allied contigent are deducted from the minima and maxima of the main list.)

To make it more short, is it allowed to field something like this?:

Allied contingent:
3 BGs of average scutarii

Main army:
3 BGs of average scutarii
3 BGs of superior scutarii

In total there is only one third of the BGs graded as superior (ok), but counting the main army only it's half (not ok).

To make things even more complicated, if this would be legal at all:
What happens if the main army contains scutarii but the allied contingent contains heavy caetrati?

I've got an oppinion for myself but wanted to check here before making a final decision.

Hi Thomas - I am not a regular list checker. Andy Ellis is the main BHGS event list checker in the UK so hopefully he will give you a view.

Personally I don't believe your example is legal. The change was introduced to allow some Superior BGs to some lists that were all average. As you rightly say Allied Contingents are specifically excluded. It therefore seems cheesy to me to include allied BGs within the total army BG count to increase the proportion of non-allied Superior BGs to 50%.

But I would accept whatever Andy thought was correct.

Thanks Pete, this is exactly what I was thinking. So, if Andy is not showing up with a different view, I can keep my decision.

Off top of my head and without looking at the list i can't give you a ruling how i would interpret it.
Ive been at work all day and I'm heading of to Bayfog comp tomorrow but will look Monday and get back to you on how i would rule it.

Another rule written a bit too quickly. I would allow 1/3 of the army's BG of that type to be Superior. It seems daft that if you take internal allies you get less superior troops. A lot of these armies were just a load of allied tribes.

And its what the rule says. 1/3 of that type can be upgraded

Hi Thomas well after a great deal of thought I'm going with that its 1/3rd from the main list not combining a ally.
