Enemy retains area control after defeat/retreat

Just had a turn where it was vital for my panzers to create a supply line through to an isolated 116th Panzer. Luckily, I defeated the closely matched 3 stack of Allied units in my way, forcing them to retreat. Unfortunately, since Axis happens to control real estate in 3 directions (2 of them empty), and the only way for the Allied units for retreating already had 2 Allied units in the space, only 1 of the Allied units, the 101st Airborne actually retreated ( see attached after combat image). and the result was that the the vital space remained under Allied control even though Axis had defeated them to the point of retreat! The beleaguered 116th is, alas, still isolated after all that.

I'm not sure if this is a bug or an issue with rules, but may I suggest:

1) in the case where a defeated combatant is forced to retreat but can't retreat , whether fully or partly, control of the zone goes to the victors
2) where a defeated enemy is forced to retreat but can't retreat, they take extra damage.

So , I guess this is more of a rules change question rather than a bug question?
Perhaps it can be moved to the main discussion forum, or I'll repost...?

The rules say, “if retreat would cause over-stacking, then the excess unit, or units, retreats into another eligible space instead. If there is no eligible space, then the excess units hold instead.”

Control to the victor seems like an elegant result -- thanks for the idea!
