Rules page 26 "A commander leading a unit in contact with enemy cannot allocate Command points nor an the unit he is with attempt a CMT"
If a division commandeer leads a assault, the unit cannot use his 1at test exception or his CPs to pass a test to pursue or pass through as it is in contact at that time , nor can any unit in his divsion (with using their brigade commander attachment 1st test exception) ?
correct?

Wouldn't enemy have routed? So no contact at that moment of pursuit?
Doesn't this primarily involve the Movement Phase?

Hm badly worded question but it's can a General use his command points to affect the unit he is with to pursue or not peruse or pass through when he was involved in combat in the combat phase? Does he count as being in contact for all this pursue/pass thorough CMTs or is it a matter of sequence (his CP's are available after his unit is not in contact when his opponents outcome move?)

We've always played that the commander leading a unit gets his free CP per phase. In your case he can use the CP to affect the pursuit and the pass through.

I think the intention was that after combat is over said general can command his own unit to pursue or not, or to pass through or retreat back from a square.
The whole not allowing CMT's might refer to him ending up in a second combat situation where he pursues into a new enemy in the second half of his pursuit and is now once again in combat till next turns combat phase, thus he can not send out orders and his unit can not attempt any formation changes or weird move things. Well that's my take on it anyway. Seems silly a unit without a general might be able to pass through or pursue or not with a test but having a general with you means you automatically fail the test since you are not allowed to take it.

At the moment of testing the unit is not in combat.
Even if the unit made a pursuit move they would only count as in combat if the pursuit was far enough for them to end in contact.
It would seem strange that a commander not with the unit could try to stop them pursuing, whereas commander with the unit couldn't.
