I started a new game and for some reason my troops (Imperium) cannot attack the Divine Ascension. I just met them early on, only one city built so far.

Hm... how can I attack, the city is empty and ripe for a surprise conquest. But I can't attack and cannot figure out why.

On the bottom of the screen you got button, one of them are Diplomacy.

Hi Canute, that's exactly what I tried, but I only got to talk to the other faction but got no dialogue option to declare war.

You need to terminate non-aggression pact first.

I had no diplomatic option to terminate any non-aggression or whatever pact.
Fiddling around in the diplomatic menu gave me no option to do so.

I don't recall EVER having declared war... either someone declared it on me of their own accord, or I hit one of their cities with an orbital bombardment and they declare war on me for that.

Now that being said you will actually have to contact the folks you want to war with to find the various options. The diplomacy screen just shows you various standings of the factions... who they are at war with and such. When you are in dialog with the other faction you will see your options, for example... if you have a trade pact but not a research pact you will see an option at the top to offer a research pact, and scrolling down you will see an option to terminate the trade pact.

It SHOULD be the same for the non-aggression pact and declaring war. I HAVE seen the option recently to declare war on someone who refused a non-aggression pact. So it's in the game... I just have never used it!

You probably just have the non-aggression pact cooldown, it lasts 5 turns or so after you cancel it.
