odd pivots

In our game today two odd situations occurred
First one: French artillery was within med range of my unit of Grenz. The French wanted to pivot so the Grenz were out of arc and a unit of horse artillery would be the only target. After they fired and it was my turn I was surprised to find out the French artillery was now within short range of my Grenzers. I had not moved but the pivot put the gun into a new range band to my unit. Was this a legal pivot since the range to the Grenzers changed, but they were not the target?
Second one: A large French battery had 3 Austrian units in its arc. We were fairly close but still at med range. The French pivoted but all 3 units remained in the French arc. Blathergut admitted the pivoting had been an attempt to move the battery all game since he either did not have points to try or had failed with his dice rolls to prolong the battery.
If the pivot results in the same targets as before the pivot, should it be taken back since no new targets are actually being brought into or out of the batteries arc?
