Charging captured artillery

From a game last night...

My oppponent broke one of my foot units, and pursued straight into a medium artillery battery capturing it. My supporting determined horse unit wanted to charge them before they could turn the guns on them.

At which point does the enemy foot count as defending the guns, and therefore ount as defending the guns, and become the target for the charge ?

They do not count as providing Rear Support to the Guns until they are lined up behind them. So not until the Guns are turned. So if the charge cannot contact the Foot it is against the Guns. Which would become recaptured but remain uncontrolled as the Determind Horse are not a Pike and Shot unit. Leaving you sat on either side of them looking at each other like Lemons.

In the end my opponent obligingly shot the guns down, and the Determined Horse than hammered home into the musket armed warriors and routed them in 2-3 turns, not bad for disrupted poor troops. :)
