elephants and overlaps

If I have an elphant in an overlap position and win the combat does my enemy take the -1 for losing against elephant modifier?

Yes. The -1 applies if the elephants added dice to the combat, whether or not the EL added any hits.

Wouldn't this only be true if you win in the melee phase?

if team elephant wins yes it would apply, otherwise team elephant sits back and watches their engaged buddies roll their cohesion test.

To clarify this basically correct statement: The elephants do not need to "win", the opposition needs to lose (overall).
