Turning onto the flank of an adjacent enemy BG

This came up at Roll Call on another table and as I disagreed with the umpire's decision I thought I'd best check if I am right or wrong.

The Rule is on pages 76 to 77:
SIDE EDGE TO SIDE EDGE CONTACT

... [opposing] Battle Groups in side edge to side edge contact are not committed to combat and are free to move away. If they do not move away, no combat occurs unless they are eligible to fight as an overlap. If not they can engage in Melee as follows:

A BG that is in side edge to side edge contact with an enemy BG can turn 90 degrees to face it ...
My reading of this is that the turning BG can only do so if they are not eligible to fight as an overlap against the BG they are turning onto.

Am I wrong? If so, why?

I believe you are correct - if you can fight as an overlap you cannot turn. The "If not" you underline in the quote is the important bit.

Only done this twice. So from memory. Done in movement phase and only if the turning BG is not providing dice to any combat and passes a CMT if needed to turn (undrilled). If turning into skirmishers who are not in combat they can evade. No impact combat takes place. Does not count as flank impact as there is no impact phase. Target conforms contacted bases to face as if in normal turn but does not need to turn the whole BG.
