How do I earn Legacy points from Government I always seem to be getting no points although i do Ok from regions, objectives etc

You'll earn Legacy points if you manage to stay alive with an Old or Decadent government. I believe you can also get some if you reach Civilization Level III while being in Golden age.

I was also curious why I see mainly 0 and other fractions have 27 from the government :)

As Pocus already mentioned you gain Legacy points from the Government if you stay as Old, Decadent or Glorious gov types. The actual value you will get depends also on your civ level (I, II, III).

According to my research for the Old government type you can get 3 or 5 or even 10 legacy (depending on the civ level). For the Decadent there is much more: 5, 15 and 30! And for Glorious it will be 0, 0, 20 per civ level, so the glorious gov type can receive 20 legacy only on civ level III.

Also "Glorious" gives you +35% bonus for legacy so in reality you will see 27 legacy from glorious level III governments.
That's why you will see 0 for quite a long time if you leverage between young, stable, glorious below level III.

I'll take the opportunity of this thread to add a little nugget of information from Kingdoms, the follow-up to Empires. In Kingdoms, contrary to Empires, being in the best status (called Glorious in Empires and Ascending in Kingdoms) gives penalties, so it is not a desired status for long. You'll want to evolve from it, or if you can't, it's better to remain stable. This was implemented to limit snowballing.
