Why is this? Is this a balance thing that is intended or a bug? When you retreat it fills up fuel completely. That is kind of annoying you should be able to chase down and kill an out of fuel fleet.

It's definitely a bug. If you put fuel tanks on starbases, they will automatically refill if you disassemble and reassemble the starbase, which makes for cheeky refueling stations (this is more an interesting oddity than something actually useful, since starbases are quite expensive and a fuel tanker caravan is cheaper anyways.
